AromaTech fragrances compete with designer brands but are not the fragrances of designer brands. AromaTech does not allege its fragrances to be exact copies of designer brands. The identification of a designer brand is done solely for comparison purposes, to give customers an indication of the character of a particular fragrance, and is permitted by the Federal Trade Commission's statement of policy regarding comparative advertising.
